FXDD 2010 F1™ Trading Contest Terms and Conditions

Prizes:

1. Grand Prize Tier - each round will have a total of three (3) winners

   First Place: Exclusive Tickets for FOM garage and pit access and $5,000 towards hotel, flight, and transportation to and from the track. The winner may take $10,000 in cash in lieu of the other items comprising the First Place prize.

   Second Place: if first place opts for the cash prize, second place may take the Exclusive Tickets in lieu of a second place prize. In the alternative, second place has the option between signed merchandise and $2,000 in cash or a $3,000 cash prize.

   Third Place: a $2,000 cash prize.

2. Standard Tier - each round will have a total of ninety one (91) winners

   First Place (1 Winner): a $5,000 cash prize and a case of Red Bull or Red Bull F1™ Merchandise

   Second Place (5 Winners): $500 cash prize each

   Third Place (10 Winners): $250 cash prize each

   Fourth Place (25 Winners): $150 cash prize each

   Fifth Place (50 Winners): $50 cash prize each

Eligibility:

1. Grand Prize Tier - Scoring will be based on total Profit and Loss (P/L).

   To be eligible for the Grand Prize Tier prizes, a customer must begin a round with at least $10,000 in a live trading account.* For the purposes of this particular contest, the term "round" shall refer to each individual Formula 1 race. There will be a total of six (6) "rounds" or individual races during the contest term.

   Customers must complete 5 standard lots per $10,000, within a one week time frame. For example: if a customer has $25,000 in their account at the beginning of a round and the round is 3 weeks long: 12.5 ($20,000= 10 standard lots + $5,000=2.5 standard lots) x 3 = 37.5; so the customer must trade at least 37.5 standard lots in order to be eligible to win a prize. For purposes of calculating total P/L for each round, the P/L will automatically reset to zero at the end of each round.

   If a customer falls below $10,000 during a round and fails to deposit sufficient funds into their account by the close of the round, they may nonetheless be eligible to win a Grand Prize Tier prize. If they want to participate in the Grand Prize Tier level in the next round they would have to deposit sufficient funds into their account at the beginning of the next round to bring their total equity to $10,000. In this instance, for example: If a customer starts round 1 with $10,000 and loses $1,000, they would have to deposit an additional $1,000 during round 2 to be eligible to win a Grand Prize Tier prize for round 2.

2. Standard Tier - Scoring will be based on a percentage of Profit and Loss (P/L) based on beginning account balance and total deposits during each round.

   To be eligible for the standard tier prizes, a customer must begin a round with at least $250 in a live trading account. Customers must complete 0.5 standard lots per $1,000 per week. For example: if a customer has $2,000 in their account at the beginning of a round and the round is 3 weeks long, 1.0 (.5 lots + .5 lots) x 3 = 3; so the customer must trade at least 3 standard lots to be eligible to win a standard tier prize for that particular round.

   Customers may not withdraw funds from their account during a round. If they do withdraw funds during around they are disqualified for that round.

   Customers may win more than one prize but are limited to one prize per round.

   *Customers who begin a round in Standard may move to the Grand Prize Tier during a round by depositing sufficient funds into the account and requesting to be moved to the Grand Prize Tier for that round.

   Customers in the Standard Tier who increase their equity from trading profits in one round will automatically be moved to the Grand Prize Tier for the next round.

   Customers may combine multiple accounts into one account to satisfy the required equity levels.

WINNERS will be announced on or about 2-5 days after the completion of a round. Limit of one prize per person per round. Winners will be notified by e-mail and phone and may be required to complete an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit”), which, if required, must be returned within 10 days of the date of notification. A failure to return the Affidavit by the required date will invalidate the winner selection and an alternate winner will be selected. If the Winner is under the age of 18, the Winner’s parent or legal guardian will be required to execute the Affidavit on behalf of the winner. Any prize notification or prize returned as undeliverable will be awarded to an alternate winner. No substitution of prizes will be permitted, unless done so at Sponsor’s sole discretion. Prizes are not transferable or redeemable for cash, unless otherwise stated. Taxes are the winner’s responsibility. Prize acceptance constitutes permission (except where prohibited) to use winner’s name and likeness for advertising and publicity purposes without additional compensation. Sponsor and its agents are not responsible for any liability associated with the acceptance or use of or inability to use a prize. Winners and the parent or legal guardian of winners acknowledge that prizes are awarded “as is” and that any representation, guarantee or warranty, express or implied, in law or in fact, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose is expressly disclaimed.

RELEASE OF LIABILITY: By entering, the entrants and the parent or legal guardian of entrants agree to hold harmless the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize won in the Contest, or their participation in the Contest, or in any prize related activity.

GENERAL TERMS: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Contest. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Contest. Sponsor reserves the right to cancel or suspend the Contest during any Round at its sole discretion. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Contest or violating the terms and conditions of the Customer Agreement and/or FXDD Trading Rules. No transfer or assignment of entries is permitted.
